Legal Notice and General Terms of Use

This English version is provided for convenience. In case of discrepancy, the Spanish legal notice is the reference text.

2. Purpose
Pulpo 3D is an on-demand 3D printing service that manufactures customized parts and objects using additive manufacturing technology (3D printing). Through the Website, users can request quotes, place orders, and make online payments.
3. Terms of use
Accessing and using the Website gives the visitor the status of user and implies full acceptance of all conditions included in this Legal Notice. The user undertakes to use the Website appropriately, in accordance with the law, good faith, and public order.
The user must be over 18 years old to make purchases through the Website.
4. Purchase process
4.1. Quote and order
The user uploads one or more 3D files (STL or other supported formats), selects the desired material, color, quality, and quantity, and the system calculates a quote automatically. When confirming the order, the user proceeds to payment.
4.2. Prices
All prices shown on the Website include applicable VAT. Shipping costs are shown separately before the order is confirmed.
4.3. Payment
Payment is processed through the secure Stripe platform. Pulpo 3D does not store users’ credit card details or financial information.
4.4. Confirmation
Once payment has been completed successfully, the user will receive an email confirmation with the order details.
4.5. Shipping and billing details
During checkout, the user may provide a shipping address and, where applicable, a different billing address and tax details. The details used in each purchase remain associated with that specific order as part of its history and are not replaced retroactively if the user later changes saved account preferences.
If the user purchases with an active account, Pulpo 3D may reuse the latest saved checkout details to speed up future purchases, without changing the details embedded in orders already placed.
5. Shipping and delivery
Available shipping areas, costs, and delivery options are shown during the purchase process before the order is confirmed. Delivery times depend on the complexity of the order and will be communicated to the user after confirmation. Delivery times are estimates and do not constitute a contractual obligation.
6. Right of withdrawal
In accordance with Article 103 of Spanish Royal Legislative Decree 1/2007 (LGDCU), the right of withdrawal does not apply to contracts for the supply of goods made to the consumer’s specifications or clearly customized.
Since all products manufactured by Pulpo 3D are produced on demand according to the customer’s specifications (3D model, material, color, quality), they are excluded from the right of withdrawal.
7. Warranties and claims
If the received product has manufacturing defects or does not match the order specifications, the user may contact us at contacto@pulpo3d.es within 14 days of receipt. We will assess each case individually and, where appropriate, offer a reprint of the product or a refund of the amount paid.
8. Limitation of use and liability for 3D printed parts
Parts manufactured and sold by Pulpo 3D are made using 3D printing technology, according to the specifications, files, measurements, materials, colors, and conditions indicated by the customer or accepted by the customer when placing the order.
Unless expressly stated in writing, parts supplied by Pulpo 3D are intended for decorative, prototyping, organizational, or general non-critical use. They are not designed, certified, or authorized for structural, safety, medical, healthcare, food-contact, electrical, automotive, aeronautical, children’s, sports, climbing, load-bearing, high-temperature exposure, fire-contact, pressure, torsion, impact, extreme humidity, chemical exposure, or any other use that may involve risk to people, animals, or property.
The customer acknowledges the inherent limitations of 3D printing, including, among others, possible dimensional variations, layer marks, anisotropy, strength differences depending on print orientation, tolerances, minor aesthetic imperfections, color variations, temperature deformation, material degradation, and loss of strength due to use, environmental exposure, or improper handling.
The customer is responsible for verifying that the part is suitable for the specific intended use, especially when providing their own designs, 3D files, measurements, instructions, or technical specifications. Pulpo 3D will not be liable for damage, loss, breakage, accidents, injuries, direct or indirect damages, loss of profit, third-party damage, or any other consequence arising from use other than expressly accepted in writing, misuse, incorrect assembly, later modification, handling, exposure to unsuitable conditions, integration into other products, or use of the part for critical or non-recommended purposes.
For customized orders, the customer assumes responsibility for the legality, suitability, safety, accuracy, and usage rights of the files, designs, logos, trademarks, models, measurements, or instructions provided. Pulpo 3D may reject any order it considers unsafe, illegal, technically unsuitable, or incompatible with the characteristics of the material or printing process.
Pulpo 3D’s liability will be limited, to the extent permitted by applicable law, to repair, replacement, or refund of the amount actually paid for the affected part, provided that the defect is attributable to Pulpo 3D and is reported within the applicable legal or contractual period. This limitation does not affect the legal rights of consumers and users or liabilities that cannot be excluded or limited under applicable law.
Use of the parts implies acceptance of these conditions, without prejudice to any legal rights that may apply to the customer as a consumer or user.
Pulpo 3D will also not be liable for service interruptions caused by technical reasons or force majeure.
9. Intellectual property
The contents of the Website (texts, images, design, source code, logos) are owned by Pulpo 3D or their legitimate holders and are protected by intellectual and industrial property laws.
The user is solely responsible for the 3D files uploaded to the Website and guarantees that they have the necessary rights for their reproduction. Pulpo 3D is not liable for intellectual property infringements arising from files provided by users.
10. Changes
Pulpo 3D reserves the right to modify these terms at any time. Changes will become effective upon publication on the Website.
11. Applicable law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of Barcelona, unless consumer regulations establish another jurisdiction.
